According to the revised Civil Code, which lowers the age of adulthood to 18 years, can an individual who is 18 years old independently undergo a medical abortion?

Dior, 10~19 year old female. Ask Date: 2023/03/30

Dr. Zhang Kunmin reply Obstetrics and Gynecology

Article 9 of the Eugenics Health Care Act stipulates that unmarried minors (under 18 years old) must obtain consent from their legal guardians in order to undergo an abortion.
Therefore, a pregnant individual under 18 cannot independently decide to have an abortion.
However, they must still comply with the provisions of the Eugenics Health Care Act: a pregnant woman may voluntarily undergo an abortion if diagnosed or certified with one of the following conditions: 1.
The individual or their spouse has a hereditary, infectious disease, or mental illness that affects reproductive health.
2.
A blood relative within the fourth degree of kinship of the individual or their spouse has a hereditary disease that affects reproductive health.
3.
There are medical reasons sufficient to determine that pregnancy or childbirth poses a risk to life or threatens physical or mental health.
4.
There are medical reasons sufficient to determine that the fetus is at risk of congenital malformation.
5.
The pregnancy is a result of rape, sexual coercion, or sexual relations with someone with whom marriage is legally prohibited.
6.
The pregnancy or childbirth would adversely affect the individual’s mental health or family life.
Unmarried minors or individuals under guardianship or assistance must obtain consent from their legal guardian or assistant to undergo an abortion as per the aforementioned provisions.
For those who are married, consent from the spouse is required according to the sixth provision.
However, this requirement does not apply if the spouse's whereabouts are unknown, or if they are unconscious or mentally incapacitated.
The determination of the circumstances under which abortion is permitted, as stated in the first paragraph, may be established by the central competent authority, as necessary, after consultation with the Eugenics Health Care Advisory Committee.
Thank you! Wishing you peace and health.

In Taiwan, the legal age of adulthood was lowered to 18 years old, which has implications for various rights, including access to healthcare services such as medication abortion. As of now, individuals who are 18 years old can legally access medication abortion without needing parental consent. This change reflects a broader trend towards recognizing the autonomy of young adults in making healthcare decisions.

Medication abortion typically involves the use of two medications: mifepristone and misoprostol. Mifepristone is taken first to block the hormone progesterone, which is necessary for pregnancy to continue. After a specified period, misoprostol is taken to induce contractions and expel the pregnancy. This method is generally considered safe and effective when used within the first ten weeks of pregnancy.

In Taiwan, the process for accessing medication abortion involves a few steps. Firstly, individuals seeking an abortion must consult with a healthcare provider, usually a gynecologist, who will assess their situation and confirm the pregnancy. The healthcare provider will also discuss the options available, including medication abortion and surgical abortion, and provide necessary counseling regarding the procedure, potential risks, and aftercare.

It is important to note that while 18-year-olds can access medication abortion, they are still encouraged to seek counseling and support. This is crucial not only for understanding the medical aspects but also for addressing any emotional or psychological impacts that may arise from the decision to terminate a pregnancy.

In terms of legality, Taiwan's laws surrounding abortion are primarily governed by the "Mother and Child Health Act," which allows for abortion under certain circumstances, including when the pregnancy poses a risk to the woman's physical or mental health, or in cases of fetal abnormalities. The law also stipulates that abortions must be performed by licensed medical professionals in approved healthcare facilities.

Moreover, while the legal framework supports access to medication abortion for adults, there may still be social stigmas or personal barriers that individuals face. It is essential for healthcare providers to create a supportive and non-judgmental environment for young adults seeking these services.

In conclusion, 18-year-olds in Taiwan can legally access medication abortion without parental consent, reflecting their status as legal adults. However, it is advisable for them to seek professional medical advice and counseling to ensure they are making informed decisions regarding their reproductive health. The healthcare system in Taiwan is equipped to provide the necessary support and services for individuals seeking medication abortion, ensuring that they have access to safe and effective options.
