I am pregnant?

I am currently 5 weeks pregnant and not yet 18 years old.
Do I need parental consent to get married and have a child? My boyfriend and I have already moved out and rented a place.
Both of our parents do not know that we are expecting a child.
Can we get a notarized marriage? We really want to have the baby.

Xiao Jie Nu, 10~19 year old female. Ask Date: 2005/11/20

Dr. Lü Lizheng reply Obstetrics and Gynecology

According to Article 973 of the Civil Code, males under the age of 17 and females under the age of 15 are not allowed to enter into a marriage contract.
Article 974 states that minors entering into a marriage contract must obtain the consent of their legal guardians.
Therefore, if you and your boyfriend meet the legal age requirements, you can proceed to have your marriage certified by the court.
If you do not meet the legal age, you will need the consent of your legal guardians (parents).
This is the legal aspect.
Additionally, the Maternal and Child Health Act stipulates that individuals or their spouses who suffer from hereditary, infectious, or mental illnesses that hinder healthy reproduction, those who become pregnant due to rape, seduction, or unlawful cohabitation, those with medical reasons sufficient to determine fetal deformities, or those whose pregnancy or childbirth may affect their mental health or family life, may undergo an abortion.
Abortions should be performed within 24 weeks.
From a social and psychological perspective, it is advisable to communicate with your parents or family members.
After all, marriage and childbirth are significant events in life, and family can be our best resource and support system.
Wouldn't it be better to receive their blessings? It is recommended to start discussions with family members who are more open to talking about these matters, approaching them sincerely, seriously, and rationally to discuss the issues or preparations related to future marriage and childbirth.
This response is provided on behalf of Director Huang Ling-Hui from the Social Services Office.

In the United States, the legal age for marriage varies by state, but generally, individuals must be at least 18 years old to marry without parental consent. In many states, those under 18 can marry with parental consent, and some states allow minors to marry with judicial approval. Since you mentioned that you are currently 17 and have been living independently with your boyfriend, it is crucial to understand the legal implications of your situation.

If you are considering marriage and having a baby at 17, you will likely need parental consent unless your state has specific provisions for minors who are pregnant or already have children. In some jurisdictions, being pregnant can expedite the process of obtaining permission to marry, but this is not universally applicable. Therefore, it is essential to check the laws specific to your state regarding marriage and parental consent.

Regarding your desire to have a baby, if you are already 5 weeks pregnant, it is important to consider the implications of this decision. Bringing a child into the world is a significant responsibility that requires emotional, financial, and social support. While you and your boyfriend may feel ready to take on this responsibility, it is advisable to discuss your plans with trusted adults or professionals who can provide guidance and support.

From a medical perspective, pregnancy at a young age can come with certain risks. Teen mothers may face higher risks of complications during pregnancy and childbirth, including preterm birth, low birth weight, and preeclampsia. Additionally, the emotional and psychological impacts of becoming a parent at a young age can be profound. It is crucial to have a support system in place, whether that includes family, friends, or healthcare providers.

Moreover, consider the importance of prenatal care. Regular check-ups with a healthcare provider can help ensure a healthy pregnancy for both you and your baby. They can provide valuable information about nutrition, exercise, and what to expect during pregnancy and childbirth.

In conclusion, while it may be possible for you to marry and have a baby at 17, it is essential to understand the legal requirements in your state, the responsibilities that come with parenthood, and the importance of having a support system. Open communication with your parents or guardians, even if they are unaware of your current situation, may provide you with additional support and resources. Seeking advice from healthcare professionals can also help you navigate this significant life change.
